The difference between HCEO and CCB

Where your debt is between £600 and £5,000 (including court costs) and you have a County Court Judgement, you can use either a County Court Bailiff or a High Court Enforcement Officer (HCEO) to enforce the debt.

High Court Enforcement Officers (HCEO)

HCEOs are authorised by the Lord Chancellor and can enforce debts under a writ of control. We can carry out the transfer up process for your CCJ or Tribunal Award and arrange enforcement.

The debt, enforcement fees, court costs and transfer up fees are collected from the debtor, but only when they collect. If the HCEO is successful in collecting your debt, you will receive the full amount back. They receive their payment through the enforcement fees.

Where the HCEO is unsuccessful in enforcing the debt they receive no income. There is an industry regulated compliance fee  of £90 (£75 plus VAT), which is paid by the creditor.

This method of payment means that HCEOs typically have higher collection rates than County Court Bailiffs, as they are paid the same regardless of whether they collect on a debt or not.

 

County Court Bailiffs (CCB)

CCBs are employed directly by the court service and receive a salary for their work. They are able to enforce judgments up to £5,000 and work under the authority of a Warrant of Execution.

Where they are successful in collecting your judgement debt, the debtor will pay court costs, warrant cost and any interest. For unsuccessful enforcements, there is no abortive fee to be paid by the creditor.
